1. Acceptance of Terms
By accessing or using the Bikes n Parts website, mobile applications, or related services ("Services"), you agree to be bound by these Terms of Service. If you do not agree to these Terms, you must not use the Services.
2. About Bikes n Parts
Bikes n Parts is an online marketplace that allows users to list, discover, and connect to buy and sell bicycles, parts, and related items.
Bikes n Parts is not a party to any transaction between buyers and sellers. All transactions occur directly between users.
We do not guarantee the quality, condition, legality, or accuracy of listings.
3. Eligibility
You must be at least 18 years old to create an account or list items for sale.
By using the Services you confirm that you:
- are legally able to enter into agreements
- will comply with these Terms and applicable laws
4. Accounts
To access certain features you may need to create an account.
You are responsible for:
- maintaining the confidentiality of your account
- all activity that occurs under your account
- ensuring your information is accurate and up to date
Bikes n Parts may suspend or terminate accounts that violate these Terms.
5. Listings and User Content
Users may upload listings, images, and descriptions ("Content").
You confirm that:
- you own the item being listed or have the right to sell it
- the listing is accurate and not misleading
- the content does not violate any laws or intellectual property rights
Listing Duration and Expiry
- Listings remain active for up to 90 days from the last meaningful update.
- Bikes n Parts may automatically deactivate or stop listings that have not been updated within this period to help keep the marketplace accurate and current.
- Sellers may update or reactivate eligible listings at any time, subject to platform rules.
Listing Accuracy and Seller Responsibility
- Sellers are responsible for ensuring listing details, pricing, stock status, and availability remain accurate.
- By submitting a listing, the seller confirms the information provided is accurate and complies with the Bikes n Parts Terms.
- Bikes n Parts may remove, stop, or deactivate listings that appear inaccurate, outdated, misleading, unavailable, or inactive.
Bikes n Parts may remove or edit listings that violate these Terms.
6. Content Licence
You retain ownership of the content you upload.
By posting content, you grant Bikes n Parts a non-exclusive, worldwide, royalty-free licence to host, display, reproduce, and promote that content as necessary to operate and promote the marketplace.
7. Prohibited Items and Behaviour
Users must not post listings or content that involve:
- stolen property
- counterfeit or infringing goods
- illegal items
- unsafe or recalled products
- fraudulent or misleading listings
Users must not:
- impersonate others
- harass or threaten other users
- attempt to bypass platform protections
- use automated scraping or bots without permission
8. Fees
Casual sellers get one free listing per month. Some listings may require a listing fee after that. Fees are shown before you confirm publication.
Fees may change over time and may vary depending on the type or value of listing.
All fees are non-refundable once a listing has been published, except where required by law.
9. Transactions Between Users
Bikes n Parts does not verify sellers or buyers and does not participate in transactions.
Sellers confirm that listed bicycles or parts are not stolen and that they have the legal right to sell them.
Users are responsible for:
- verifying item condition
- arranging payment and delivery
- complying with applicable laws
Bikes n Parts is not responsible for disputes between users.
10. Reporting Listings
Users may report listings that appear fraudulent, illegal, or misleading.
We may investigate reports and remove listings at our discretion.
11. Limitation of Liability
To the maximum extent permitted by law, Bikes n Parts is not liable for:
- losses arising from transactions between users
- inaccurate or misleading listings
- service interruptions or technical issues
- loss of data or content
Where liability cannot be excluded under Australian Consumer Law, our liability is limited to the minimum extent permitted.
12. Indemnity
You agree to indemnify Bikes n Parts against claims, damages, or losses arising from:
- your listings
- your transactions
- your breach of these Terms.
13. Termination
We may suspend or terminate accounts or access to the Services if users breach these Terms or misuse the platform.
14. Changes to the Services or Terms
We may update these Terms from time to time. Continued use of the Services indicates acceptance of the updated Terms.
15. Governing Law
These Terms are governed by the laws of New South Wales, Australia.
